Virginia’s New Wage Statement Requirements for 2020

Did you know as of January 1st this year, Virginia employers are required to provide employees with an itemized wage statement “each regular pay date”?

Prior to 2020, employers were only required to provide wage statements upon request.

Virginia Code § 40.1-29 has been amended to require nearly all employers operating in Virginia with exceptions for those in the agricultural industry. The new law also applies to both exempt and non-exempt employees.

If you are not already providing these employee wage statements regularly, here is what you will need to incorporate at a minimum either by a paystub or online accounting:

  • The employer’s name and address
  • The number of hours the employee worked during the pay period
  • The employee’s rate of pay
  • The gross wages earned by the employee during the pay period
  • The amount and purpose of any payroll deductions
